Theodora Miller, LLC, a Virginia limited liability company, (”we,” “us,” or “TM LLC”) takes your privacy seriously. This written privacy policy (this “Privacy Policy”) governs the data collected by us through our website located at www.theodoramiller.com (our “Site”), including, your information, and how we use the same. By accessing/browsing our Site, using the Services, purchasing our Products or Commissions, subscribing to our newsletter, if any, or any combination of the same, you agree to be bound by this privacy policy (this “Privacy Policy”).

1. YOUR AGREEMENT

You affirm that (i) you are at least eighteen (18) years old; (ii) you are a United States resident; and (iii) you have authority to agree to this Privacy Policy and are competent and capable of understanding, agreeing to, and complying with this Privacy Policy. We do not knowingly collect any Personal Information (defined below) from children under eighteen (18) years old. Further, we will delete any Personal Information collected that we later determine is from a person younger than eighteen (18) years old. You agree that this Privacy Policy is supported by reasonable and valuable consideration (which consideration includes your use of our Site), and you acknowledge your receipt of and the sufficiency of the consideration. If you do not agree with all of the provisions of this Privacy Policy, do not use our Site.

When you are no longer an active user of our Site, we may continue to use and share your information as described in this Privacy Policy. This Privacy Policy only applies to our use of information collected from you. It does not apply to the practices of any bank or payment processor used by TM LLC or for other third-party transactions related to your activity on our Site.

Throughout this Privacy Policy, we use the term "Personal Information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been aggregated, anonymized, or both so that it does not identify a specific user. TM LLC will own such aggregated and anonymized information. “Personal Information” for purposes of this Privacy Policy also does not include any profile information, messaging, or other information that would be visible to visitors to our Site, or visible to other users of TM LLC services and products.  

2. PERSONAL INFORMATION WE COLLECT

Information We Collects. 

When you use our Site, we receive and collect information, including personal information. “Personal Information” includes any information you provide us that could reasonably be used to personally identify you. The data we collect depends on the services and features you use, and could include the following types of information, some of which may include Personal Information:

Information You Provide Directly to Us

  • Self-Reported Information. We might collect your first and last name, email address, phone number, zip code, and other similar contact information. 

  • User Content. You may be provided with the ability to post, submit, upload, embed, display, communicate, or otherwise distribute text, data, graphics, external links, or other materials (“User Content”). We collect User Content when you submit it to us, such as subscribing to our newsletter, providing us feedback, or reviews of our products or services. User Content may be stored by us, displayed to other users, or used for promotional purposes. User Content may be read, collected, and used by third parties. You should exercise caution before you share Personal Information in your User Content.

Device Information. 

We collect information from your computers or mobile devices, either directly or via analytics partners, including your activity on our Site across devices. This includes data such as IP addresses, geo-location, time zone, cookie information, mobile device, advertising identifiers, browser and version, operating system type and version, mobile network information, device settings, and software data. Location. 

Our analytics partners collect location information from sources such as IP addresses and mobile phone network data. You can manage your location preferences and opt out of location tracking by using the location settings on your devices and within your web browser.

Technical Information.

We collect information about how you and your device interact with our Site and the Services, our Products, and Commissions, including, for example: (1) referring source (i.e., the site you visited prior to visiting our Site); (2) date and time of access to our Site; (3) our Site pages visited and our Site features used, and the order of use; (4) type of computer or other operating device accessing Site, type of browser used to access our Site, and type of operating system you use; and (5) other similar information about the interaction between your browser and our Site. The cookies we use in connection with our Site are automatically deleted from the user’s computer or operating device when the browser is closed and the session has ended. We will only collect and use that information to the extent that such collection and use is permitted by the third-party services. 3. HOW WE PROTECT AND STORE PERSONAL INFORMATION

We store and process your Personal Information using third party servers located in data centers in the United States of America. We also use customary computer safeguards such as firewalls and data encryption, enforce physical access controls to our office and files, and authorize access to personal information only for those who require it to fulfill their responsibilities for TM LLC.

We strive to ensure security on all of our systems. Despite our efforts, we cannot guarantee that personal information will not be accessed, disclosed, altered, or destroyed by breach of our administrative, managerial, and technical safeguards. Safety and security of your Personal Information also depends on you. You should not send us credit card information or other sensitive information via email, and you should not place orders with us via email, as this is not secure. If we allow you to create an account and you have an account on our Site, you are responsible for keeping your username and password confidential. Please notify us if you become aware that your Personal Information is lost, stolen, or used without permission. We may disable access to your Site account, if any, in order to prevent an unauthorized third party from accessing your account. Further, in the event of an unauthorized use of your credit card, you should contact your card issuer immediately. If we learn of a systems security breach, we may attempt to notify you electronically so that you can take appropriate steps. TM LLC uses your Personal Information for the purpose stated when we ask for such Personal Information. We also use such Personal Information as described elsewhere in this Privacy Policy to provide our Site and its features and to send you communications, including, to:

  • provide the Services, our Products, and Commissions;

  • diagnose problems with our Site and to provide user support;

  • to customize and tailor your experience using our Site;

  • to make our Site more compatible with technology used by our users, to analyze statistical use patterns, and to otherwise improve our Site;

If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or contacting us), we reserve the right to contact you for non-marketing purposes relating to your purchases or other use of our Site, the Services, our Products, and Commissions.

5. HOW WE SHARE PERSONAL INFORMATION 

Information Shared with Third Parties. 

Except in the circumstances described in this Privacy Policy, we do not share, sell, rent, license, trade, or otherwise transfer or disclose your Personal Information with or to third parties for their promotional purposes. We may share de-identified, aggregated information without restriction.

Order Fulfillment.

Currently, our third party services providers listed below use your payment/credit card information, address, and other personal information to process purchases you initiate, subject to their respective privacy policies and opt-out processes. We do not receive your information directly for order fulfillment. We do not access or store your credit card number or bank account number and therefore cannot disclose it to anyone. That information will be provided to our payment processor and will be safeguarded in accordance with their privacy policies. Third-Party Service Providers. 

We share information with our third-party service providers who assist us by performing services related to our operation of our Site (such as hosting, data storage, payment processing, and security) and to conduct marketing on our behalf.  

Third-Party Analytics Services. 

We may use third-party analytics services to assist us in better understanding users of our Site. For example, we may use these services to track and analyze certain information, such as feature usage. We only ever provide these service providers with (or allow these service providers to collect on our behalf) the technical information described above. We use the information collected from these service providers to make our Site better and easier to use. The information we receive from these third parties may be re-associated with your Personal Information after we receive it back from these third parties. In particular, we use Google Analytics to evaluate and improve our Site and offer you more personalized services and products.

We may transfer your Personal Information to another entity owned or controlled by TM LLC or its members or another entity if TM LLC is involved in a merger, acquisition, reorganization, restructuring, or other sale or transfer of all or any portion of its assets or business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which information of our Site users are among the assets transferred. In this event, we will, if allowed, use reasonable efforts to notify you when your information is transferred to a third party (this notification may be made via email to you or by posting a prominent notice on our Site). Unless you consent otherwise, your Personal Information will remain subject to the promises made in this Privacy Policy, even after the transfer. But any information you provide after the transfer will likely be subject to a new privacy policy, and you should review that policy.

Required by Law.  

We reserve the right to release your information if we believe in good faith that (i) such release is required to comply with any law, rule, or regulation, or any search warrant, subpoena, court order, or similar legal process; or (ii) disclosure is necessary to protect or enforce our rights or property, to protect the rights or property of others, to protect your safety or the safety of others, in emergency situations, to defend against legal claims, to enforce our contractual or other rights, or to take action regarding illegal activities or suspected fraud.

Public Areas of Site.  

Our Site, from time to time, might contain areas where users can post User Content that will be viewable by other users of our Site or affiliated sites. You should be aware that when you voluntarily disclose Personal Information on these areas of our Site for public viewing, the information may be collected, stored, used, and disclosed by other users of our Site. Such activities are beyond our control, and we shall have no responsibility for or liability regarding the protection or security of such User Content. Do not post Personal Information that you want to keep private on these areas of our Site.

6. CONTROLLING YOUR INFORMATION

Controls.

You can manage or review your account information, marketing preferences, and user data. Retention and Storage of Information. 

We may retain all Personal Information in our databases until you ask us to remove your information from our databases. Note that even after you ask that we remove your information from our databases, it may be impossible to remove some information, such as information tracked in our web server log files and information that may reside in backup files. This residual information is retained to preserve the integrity of backed-up files and for business continuity purposes. We may also retain certain technical information even after you request that we remove your information from our databases, for use in the aggregate and to analyze and improve our Site and affiliated sites. Further, even after you request that we remove your information from our databases, we may retain Personal Information with any document retention policy and to comply with applicable laws, rules, regulations, or guidelines; to prevent fraudulent activity; to protect ourselves against liability; to resolve disputes; to enforce our contractual or other rights; to permit us to pursue available remedies and limit any damages that we may sustain.

Do Not Track.

We do not track its users over time and across third-party websites to provide interest-based advertising and therefore does not respond to Do Not Track signals. However, our third party analytics partners may keep track of your browsing activities for analytics purposes. Our Site does not support Do Not Track (DNT) at this time. DNT is a privacy preference you can set in your web browser to indicate that you do not want certain information about your web page visits tracked and collected across websites. 7. CHILDREN’S PRIVACY 

We do not knowingly solicit or collect information from anyone under the age of 13. In the event that we learn that we have inadvertently collected personal information from someone under age 13, we will take reasonable steps to delete that information. This Privacy Policy applies only to information collected through your use of our Site. Our Site may contain links to other third-party websites, products, or services that are not owned or controlled TM LLC. Our Site may contain links to other third-party websites. We do not control the information collection of third-party websites that can be reached through links from our Site, including, third-party service provider for merchant services and providing other services in connection with our Site. We encourage our users to be aware when they are leaving our Site and to read the privacy statements of any third-party website that collects personally identifiable information. If we make material changes, we may notify you by posting an announcement on our mobile application, on the homepage of our website, or by sending you an e-mail. It is your responsibility to periodically review this Privacy Policy; users are bound by any changes to the Privacy Policy by using our Site after such changes have been posted. This Privacy Policy is subject to the Terms of Use. All capitalized terms not defined herein have the meaning set forth in the Terms of Use.
